5.4 million Americans--1 in every 40 voting age adults-- are denied the right to participate in democratic elections because of a past or current felony conviction. In several American states, 1 in 4 black men cannot vote due to a felony conviction. In a country that prides itself on universal suffrage, how did the United States come to deny a voice to such a large percentage of its citizenry? What are the consequences of large-scale disenfranchisement--both for election outcomes, and for public policy more generally? Locked Out exposes one of the most important, yet little known, threats to the health of American democracy today. It reveals the centrality of racial factors in the origins of these laws, and their impact on politics today. Marshalling the first real empirical evidence on the issue to make a case for reform, the authors' path-breaking analysis will inform all future policy and political debates on the laws governing the political rights of criminals.

Prisoner enfranchisement remains one of the few contested electoral issues in twenty-first-century democracies. It is at the intersection of punishment and representative government. Many jurisdictions remain divided on whether or not prisoners should be allowed access to the franchise. This book investigates the experience of prisoner enfranchisement in the Republic of Ireland. It examines the issue in a comparative context, beginning by locating prisoner enfranchisement in a theoretical framework, exploring the arguments for and against allowing prisoners to vote. Drawing on global developments in jurisprudence and penal policy, it examines the background to, and wider significance of, this change in the law. Using the Irish experience to examine the issue in a wider context, this book argues that the legal position concerning the voting rights of the imprisoned reveals wider historical, political and social influences in the treatment of those confined in penal institutions.

This collection of articles critically examines legal subjectivity and ideas of citizenship inherent in legal thought. The chapters offer a novel perspective on current debates in this area by exploring the connections between public and political issues as they intersect with more intimate sets of relations and private identities. Covering issues as diverse as autonomy, vulnerability and care, family and work, immigration control, the institution of speech, and the electorate and the right to vote, they provide a broader canvas upon which to comprehend more complex notions of citizenship, personhood, identity and belonging in law, in their various ramifications.

State felony disenfranchisement laws that date back to Reconstruction fracture the American electorate into “those who are citizens in the fullest sense of the term,” in Aristotle’s words, and those who, deprived of political voice, still have the status of slaves. The existence of this "invisible constituency"—approximately 5.8 million or 2.5% of the national voting population—who live alongside the “ruling” enfranchised electorate—is one of the scandals of our generation. In this second edition of Felony Disenfranchisement in America, Katherine Irene Pettus draws on philosophy, history, law, and punishment theory to make the compelling argument that state disenfranchisement policies have collective moral and political significance that transcends the personal tragedy of being legally deprived of full citizenship status. Pettus argues that the war on drugs, mass incarceration, and racially unbalanced disenfranchisement rates distort and disfigure the body politic as a whole, and undermine the legitimacy of the domestic and foreign policies promulgated by our elected representatives.

In the twenty-first century, fighting impunity has become both the rallying cry and a metric of progress for human rights. The new emphasis on criminal prosecution represents a fundamental change in the positions and priorities of students and practitioners of human rights and transitional justice: it has become almost unquestionable common sense that criminal punishment is a legal, political, and pragmatic imperative for addressing human rights violations. This book challenges that common sense. It does so by documenting and critically analyzing the trend toward an anti-impunity norm in a variety of institutional and geographical contexts, with an eye toward the interaction between practices at the global and local levels. Together, the chapters demonstrate how this laser focus on anti-impunity has created blind spots in practice and in scholarship that result in a constricted response to human rights violations, a narrowed conception of justice, and an impoverished approach to peace.

To anyone setting out to explore the entanglement of international criminal justice with the interests of States, Germany is a particularly curious, exemplary case. Although a liberal democracy since 1949, its political position has altered radically in the last 60 years. Starting from a position of harsh scepticism in the years following the Nuremberg Trials, and opening up to the rationales of international criminal justice only slowly - and then mainly in the context of domestic trials against functionaries of the former East German regime after 1990 - Germany is today one of the most active supporters of the International Criminal Court. The climax of this is its campaigning to make the ICC independent of the UN Security Council - a debate in which Germany took a position in stark contrast to the United States. This book offers new insight into the debates leading up to such policy shifts. Drawing on government documents and interviews with policymakers, it enriches a broader debate on the politics of international criminal justice which has to date often been focused primarily on the United States.

The German Congress on Crime Prevention (GCOCP) is an annual event that takes place since 1995 in different German cities and targets all areas of crime prevention. Since its foundation the GCOCP has been open to an international audience with a growing number of non-German speaking participants joining. To give the international guests their own discussion forum, the Annual International Forum (AIF) within the GCOCP was established in 2007. For international guests this event offers lectures in English language as well as other activities within the GCOCP that are translated simultaneously. This book reflects the outcomes of the 4th AIF (10. and 11. of May 2010 in Berlin) and 5th AIF (30. and 31. of May 2011 in Oldenburg). The articles reflect worldwide views on crime prevention and criminal policy as well as the current status, discussion, research and projects in crime prevention from different countries. Also both the Berlin and Oldenburg Declarations are included, reports about the key findings of both congresses.
