This book presents the general principles of contract law that apply in the countries of the University of the South Pacific ('USP') region - Cook Islands, Fiji Islands, Kiribati, Marshall Islands, Nauru, Niue, Tokelau, Tonga, Tuvalu, Samoa, Solomon Islands, and Vanuatu. It is unique in that it provides the only up-to-date survey of regional authorities for the principles of contract operating within the region. Like many other branches of the law, contract law has yet to establish its own identity in the South Pacific. However, whilst it is still based on the law of England, there are significant differences between English contract law and South Pacific contract law. The text provides a clear explanation of this divergence and highlights regional innovations, both in the form of legislation and local case law. It also examines the role of customary law and provides a comprehensive study of the significant differences between the law of contract in individual regional countries. Comparison is made between regional law with current English contract law, and with the contract law of Australia and New Zealand, particularly where regional courts have preferred that law to the law of England. This book is essential reading for all students of contract law in the South Pacific and constitutes a very useful source book and guide for academics and practitioners, from within and outside the region.

Essentials of Law for Health Professionals 3e has been thoroughly revised and updated throughout to reflect the most recent changes in legislation relevant to the provision of health care services in Australia. Employment status of health professionals and issues of work cover, health and safety obligations, anti-discrimination issues are clearly outlined and discussed in the new edition. Legal issues surrounding genetics, fertility and surrogacy are reviewed in conjunction with the current position on abortion and wrongful deaths. The breadth of material is presented in a manner that is more in keeping with a student resource text rather than a law book. The new third edition continues to present contemporary issues relevant for Health Science students from the clinical setting through to management and employment, as they apply to each state. Streamlined new edition includes updates to key chapters such as: Chapter 5 Negligence, which has been completely rewritten to discuss negligence by jurisdiction Chapter 8 Manipulation of Life now deals with topical and controversial issues such as abortion, wrongful death, tissue transplants, genetics and infertility Chapter 10: Contractual and Industrial Elements of Professional Practice has been updated to include the most recent changes to Industrial Relations Law, information that is essential for any Health Professional entering into employment. This new edition, the fourth, will be widely and warmly welcomed. Massive changes have taken place. There have been 15 amendments to the Mining Act and 28 amendments to the Mining Regulations since the third edition. In that period, there has been a substantial volume of case law through decisions in the High Court, the Supreme Court and the Wardens' Courts. Other significant changes have arisen as a result of another seven yearsâ™ experience of the impact of the Native Title Act upon the application of mining law. The most important changes for practitioners of mining law have been made in the area of proceedings before the warden where the administrative and judicial functions ofthe warden have been separated. The new edition reflects all these changes and states the lawas at 1 October 2008. The basic structure of previous editions is retained - chapter by chapter commentary which follows the layout of the Mining Act itself. Although the book deals with mining law in Western Australia, it has always been regarded as having a relevance to the mining industry in other States and the Northern Territory, as broadly similar principles apply throughout Australia. This relevance has been enhanced in the fourth edition because of the expanded coverage of case law and native title issues.
