The Senate is a place where political minorities and individual members hold great power, resting on authority drawn from Senate rules and over two hundred years of related precedents and traditions. The minority has and will always have a clear and important voice on issues brought to the Senate floor, and it is this distinction from the majority rule of the House that has enabled the Senate to work as well as it has since our democracy's inception. Now in its third edition, Senate Procedure and Practice explains why and how the Senate has worked for more than 200 years. It includes the updated modifications of procedures governing Senate debate, amendment rights, and the formation of conferences. The book is filled with fascinating stories and insights that highlight why certain rules are in place, how they are practiced, and the ways in which those practices have changed throughout history as our federal government and the needs of our electorate have evolved. Anyone with an interest in the pillars of Senate procedure and practice will find a useful companion in this book.

The United States is often referred to as the world's greatest deliberative body. And that is for good reason. The Senate Chamber—from its inception to its Golden Age to the present day—has been the setting for some of the most moving, decisive, and consequential debates in American history. But how does the Senate work? Senate Procedure and Practice not only answers this question but also explains and illustrates why the Senate has worked so well for more than 200 years. This practical, real-world explanation focuses on the three pillars of legislative procedure: the Senate rules, the parliamentary interpretations of the Senate rules, and statutes that impose procedural rules. The book is filled with fascinating stories and insights that highlight why a given rule is in place and how it is practiced. Now in its second edition, the book has been updated to discuss the impact the Democratic takeover has had on basic Senate procedures and practices, including much-discussed Rule XXVIII.

Tiefer has brought under one cover the contributions of many political writers, and practicing senators and representatives. His 12-page introduction reveals the extent of his reliance on their works. The subtitle summarizes the totality of his coverage of the subject. . . . Tiefer's experiences in various positions serving senators and representatives as well as in his present positions at Georgetown University Law Center and as deputy general counsel of the House of Representatives have enabled him to examine thoroughly the procedures and practices in the detailed complexity of everyday life in the US Congress. "Choice" Tiefer's Congressional Practice and Procedure is the most current, complete, and scholarly treatise on the subject . . . a comprehensive, detailed, well-organized, and thoroughly researched guide. . . . Its thirteen heavily footnoted chapters are full of anecdotes and historical examples, some of them as current as Vice President Quayle, which weave together the formal, the historical, and the political aspects of congressional rules and functioning. . . . Advanced students thirsting for a sophisticated guide through the complexity and detail of congressional procedure will find it rewarding. "RQ" In national decisions on crucial issues such as taxing and spending, health, economic regulation, defense, civil rights, and many other policy areas Congress occupies a commanding position. And, while many observers know generally how Congress proceeds, only a few insiders understand the complexities of the process. Congressional Practice and Procedure systematically examines Congressional procedure beginning with a perspective on how procedure and power play off each other. Tiefer explains how Congress structures itself, including the vital processes of appointing members, and referring bills, to choice committees and follows the progress of bills through various committee and subcommittee processes. Tiefer discusses House floor procedure, the roles of the Speaker and other leaders, the intricacies of the complex special rules, and focuses on the strategies of majority and opposition floor managers. The book describes the delicate balance between the Senate leadership and powerful individual Senators, leadership perogatives and unanimous consent agreements, and discusses at length the revolution in filibusters and cloture in the 1970s and the 1980s. The author also discusses conference committees and the all-important budget-appropriations process. Meticulously documented with two thousand detailed textual footnotes to official, journalistic, and academic sources and an extensive bibliography, this authoritative and scholarly reference will be of immediate value to practicing attorneys, lobbyists, trade associations, and government relations specialists. Libraries, academicians and political science researchers will find it immensely useful as a major source of material on Congress.

Special rules enable the Senate to act despite the filibuster. Sometimes. Most people believe that, in today's partisan environment, the filibuster prevents the Senate from acting on all but the least controversial matters. But this is not exactly correct. In fact, the Senate since the 1970s has created a series of special rules—described by Molly Reynolds as “majoritarian exceptions”—that limit debate on a wide range of measures on the Senate floor. The details of these exemptions might sound arcane and technical, but in practice they have enabled the Senate to act even when it otherwise seemed paralyzed. Important examples include procedures used to pass the annual congressional budget resolution, enact budget reconciliation bills, review proposals to close military bases, attempt to prevent arms sales, ratify trade agreements, and reconsider regulations promulgated by the executive branch. Reynolds argues that these procedures represent a key instrument of majority party power in the Senate. They allow the majority—even if it does not have the sixty votes needed to block a filibuster—to produce policies that will improve its future electoral prospects, and thus increase the chances it remains the majority party. As a case study, Exceptions to the Rule examines the Senate's role in the budget reconciliation process, in which particular congressional committees are charged with developing procedurally protected proposals to alter certain federal programs in their jurisdictions. Created as a way of helping Congress work through tricky budget issues, the reconciliation process has become a powerful tool for the majority party to bypass the minority and adopt policy changes in hopes that it will benefit in the next election cycle.
