This book addresses practitioners in development cooperation as well as scientists and students who are interested in the interaction of human rights and development issues. In the practice of development cooperation, linking poverty reduction programs with human rights is mainly achieved using so-called “Rights-based Approaches to Development.” In this context the right to an adequate standard of living (including access to food, water and housing), the right to health and the right to social security are of particular importance – human rights that will play a key role in the design of the Post-2015 Development Agenda, which is currently being negotiated as a framework to succeed the Millennium Development Goals. The book provides an overview of the main international legal standards that are relevant for the protection of social rights, while also analyzing the content of those rights. Moreover, it informs readers on the current debates surrounding the extraterritorial obligations of donor countries and the duties of transnational corporations and international organizations (e.g. the World Bank and WTO) with regard to the implementation of social rights in the Global South.

This volume examines the impact of the Trump presidency on development aid. It starts out by describing the rise of national populism, the political landscape and the reasons for rejection of the political establishment, both under Trump and internationally. Next, it gives a historical-political overview of development aid in the post WW-II era and discusses the dominant Washington Consensus doctrine and its failure. It then provides a critique of the Official Development Assistance (ODA) discourse and reviews the political economy of ODA, the discourse, and the conditionalities that are barriers to socio-economic development. The final chapters explore the question of Trumponomics as an alternative to the global neoliberal ODA, and the potential impact of Trumponomics’ on ODA. The book concludes with thoughts on the potential future directions for ODA within the ‘ideals’ of Trumponomics and national populism.

The Theory of Contestation advances critical norms research in international relations. It scrutinises the uses of ‘contestation’ in international relations theories with regard to its descriptive and normative potential. To that end, critical investigations into international relations are conducted based on three thinking tools from public philosophy and the social sciences: The normativity premise, the diversity premise and cultural cosmopolitanism. The resulting theory of contestation entails four main features, namely types of norms, modes of contestation, segments of norms and the cycle of contestation. The theory distinguishes between the principle of contestedness and the practice of contestation and argues that, if contestedness is accepted as a meta-organising principle of global governance, regular access to contestation for all involved stakeholders will enhance legitimate governance in the global realm.

This brief reference surveys the national policy of three representative African countries on the legal guardianship of children who are without parents or families. Focusing on the widely varying legal systems of Côte d’Ivoire, South Africa, and Uganda, the authors highlight guardianship as emblematic of the continent’s shortcomings in child protection laws. The book’s key objective is bridging the communal aspects of traditional African society with the global standards set forth by the Convention on the Rights of the Child and other international entities. To this end, the three frameworks discussed here are compared and their strengths and limitations evaluated as applied to child protection standards in terms of core guardianship issues: Holders of parental authority and responsibilities Appointment of a legal guardian Who qualifies as a legal guardian? Responsibilities of a legal guardian in relation to the child Termination of guardianships The primary audience for Perspectives on the Legal Guardianship of Children in Côte d'Ivoire, South Africa, and Uganda includes academics, researchers, and students in the fields of children’s rights, human rights, legal guardianship, and international law. It will also prove a useful reference for NGOs that focus on children’s rights, social workers and practitioners operating within the context of these three countries, professionals working within the African human rights system, and governmental law- and policymakers.

This book starts with an exercise, proposing a theoretical reflection on the technological path that, over time, has transformed the ways we produce, consume and manage intellectual content subject to copyright protection. This lays the groundwork for a further analysis of the main legal aspects of the new European Directive, its improvements, its tendencies and its points of controversy, with special and more concrete attention to how it proposes to address the issues of competition, transparency and multi-territorial licensing. Digital technologies, networks and communication have boosted the production and distribution of intellectual content. These activities are based on a renewable and infinite resource – creativity – which turns this content into strategic artistic, cultural, social, economic and informational assets. Managing the rights and obligations that emerge in this system has never been an easy task; managing them collectively, which is more often than not the case, adds even more complexity. The European Directive on collective management of copyright and related rights and multi-territorial licensing of rights in musical works for online use in the internal market is a policy initiative that seeks to establish an adequate legal framework for the collective management of authors’ rights in a digital environment, recognizing this goal as crucial to achieving a fully integrated Single Market. Part of the Digital Agenda for Europe, it is an effort to promote simplification and to enhance the efficiency of collective rights management by tackling three of the main issues that are currently undermining the business model of collecting societies: competition, transparency and multi-territorial licensing. The book is intended to support students, academics and practitioners by enhancing their general and legal grasp of these phenomena, while also encouraging their collaboration with policymakers and other interested parties in the ongoing task of transposing the Directive into concrete national legislation.

The Social Protection Floor Initiative promotes universal access to essential social transfers and services. Presently 80% of the global population does not enjoy a set of social guarantees that allows them to deal with life's risks such as unemployment, ill health, and natural disasters. This book explores the importance and necessity of social protection, including key concepts, universal principles and human rights, the need for context-specific policies, the role of adaptive climate change, and country examples. Social protection refers to a set of essential transfers, services and facilities that all citizens everywhere should enjoy to ensure the realization of the rights embodied in human rights treaties. The Social Protection Floor aims to facilitate and accelerate the introduction or strengthening of sustainable context-specific social protection systems. Experiences from countries around the world that have implemented components of the Social Protection Floor provide evidence of its feasibility, affordability, and impact. The promise and success of social protection is important for transformative change, social inclusion, and alliance building, and raises critical questions about current neoliberal austerity measures. This book calls for a comprehensive, multi-dimensional, integrated and innovative policy mix that recognizes the interdependency between demographic shifts, employment, labour migration, social protection, economic development, and the environment.

By examining the implementation dynamics of EU Readmission Agreements (EURAs), this book addresses the practical reasons why irregular immigrants cannot be expelled. EURAs are one of the vital legal instruments framing EU external migration law with regard to the expulsion of irregular immigrants, yet their implementation has met with various obstacles. Above all, the process of determining an individual’s legal identity has proven to be one of the most controversial aspects in the implementation of EURAs. The analysis shows that the process of identifying who is whose national in the context of readmission creates two existential dilemmas: first from the perspective of the sovereignty of third countries of origin and the legal standards laid out in international instruments as regards states’ powers in determining nationality, and second regarding the agency of the individual as a holder of fundamental human rights. How do the EURAs deal with or aim at alleviating these identity determination dilemmas? The book provides a comparative analysis of the administrative procedures and rules envisaged by EURAs aimed at proving or presuming the nationality of the persons to be readmitted to their country of origin. It focuses on the ways in which nationality is to be determined or presumed in the scope of the 2010 EURA with Pakistan, and compares it with those foreseen in the EURAs with Armenia, Azerbaijan, Cape Verde, Georgia, and Turkey. As such, the book provides a unique and up-to-date study of EURAs and their implementation challenges in the broader context of EU external migration law and policy.

This monograph analyses and describes successful educational actions with a specific focus on vulnerable groups (i.e. youth, migrants, cultural groups e.g. Roma, women, and people with disabilities). Concrete data that shows success in school performance in subject matters such as math or language will be provided, as well as children, teachers and families accounts of the impact of this success. Alongside, there is an analysis of the relationship between these children’s educational performance with their inclusion or exclusion from different areas of society (i.e. housing, health, employment, and social and political participation). Many studies have already diagnosed and described the causes of educational and social exclusion of these vulnerable groups. This monograph, however, provides solutions, that is, actions for success identified through the INCLUD-ED project, thus providing both, contrasted data and solid theoretical background and development. Some examples of these actions are interactive groups (or heterogeneous grouping in the classroom with reorganisation of human resources), extension of the learning time, homework clubs, tutored libraries, family and community educative participation, family education, or dialogic literary gatherings. All these actions have been defined as successful educational actions, which mean that they lead to both efficiency and equity. Finally, recommendations for policy and practice are included and discussed.
