As a result of the digital revolution and the ever-increasing use of the internet, discussions around the conflict between copyright and the public domain are more prevalent than ever before. While these discussions have been hotly debated by legal scholars and in blogs and online forums, Terms of Use is one of the first books to concentrate on the conceptual foundations of the public domain. Taking an interdisciplinary approach, Eva Hemmungs Wirtén reveals the nineteenth-century origins of contemporary phenomena such as blogs, wikis, the "Creative Commons," as well as the "Open Source" and "Open Access" movements. Hemmungs Wirtén examines topics as diverse as the pharmaceutical uses of plants, the patenting of DNA sequences, and Disney's reworking of Rudyard Kipling's Jungle Books in order to provide a frank theoretical discussion of how nature and culture have been transformed into intellectual property. Timely and provocative, Terms of Use will challenge and inspire readers by providing an original and innovative approach to the understanding of the public domain and its origins.

The Rhetoric of Religious Cults takes as its departure point the notion that 'cults' have a distinctive language and way of recruiting members. First outlining a rhetorical framework, which encompasses contemporary discourse analysis, the persuasive texts of three movements - Scientology, Jehovah's Witnesses and Children of God - are analysed in detail and their discourse compared with other kinds of recruitment literature. Cults' distinctive negative profile in society is not matched by a linguistic typology. Indeed, this negative profile seems to rest on the semantics and application of the term 'cult' itself.

Masterarbeit aus dem Jahr 2010 im Fachbereich Jura - Andere Rechtssysteme, Rechtsvergleichung, Note: B, University of Auckland, Sprache: Deutsch, Abstract: This paper deals with the non-use of registered trade marks. It mainly focuses on the trade mark system of New Zealand; however it compares this with selected issues of foreign trade mark systems. Unexpectedly, the non-use of registered trade marks is a topic which closely relates to the vivid field of promotion, competition, and globalization, although it is embedded in the rather static system of registration and administration. The non-use of a registered trade mark enables the opposition to initiate a procedure of revocation from the trade mark register against the respective trade mark. With removal from the trade mark register the trade mark rights of the owner hereby granted cease. Therefore, the application of revocation from the trade mark register in terms of non-use is, beside other grounds for removal, a common tactic of competitors to shed blocking trade marks. This paper shall give an overview of the formal procedure of application, including the legal aspects of the requisite standing, the competent forum and the burden of proof. However, the main focus of this analysis encompasses the legal term and definition of the use (“genuine use”) of a trade mark. Unfortunately, New Zealand legislation as well as other Common Law and Civil Law jurisdictions gives minimal guidance on the interpretation of the term “genuine use”. Although, European jurisdiction created and confirmed a common understanding by pointing out some main criteria, this definition only constitutes a framework. Subsequently, the term has been formed through case-by-case decisions of national and overseas courts and the Intellectual Property Office. Therefore, this paper will provide different case examples of the jurisdiction of New Zealand and other jurisdictions. However, the line of cases will show the variety regarding the determination of “genuine use”. A comprehensive and universal definition of the term cannot be established. Actions made in respect of a trade mark can only be evaluated as “genuine use” in regard to the specific circumstances.

With consumer goods, as weil as consumer durables, the market is obscured because of product differentiation, in for example, the use, of trade marks, and the advertising and get-up of products, and this presents arealproblern in the protection of consumers. After a general demarcation of the forms, techniques and functions of product differentiation, an investigation is made into the correlation between the law and product differentiation; first, regarding pharmaceutical products and, then, though only by way of reconnaissance, for foodstuffs and cosmetics. Both in the general descriptive part and in the parts dealing with various sectors, attention is also paid to product differentiation as a source of the geographical division of markets. In a later chapter, certain general Observations on the law and socially undesirable product differentiation are developed. Here special attention is paid to trade mark law and regulations relating to misleading and dishonest advertising. The survey shows that, in the light of the existing economic model, improved consumer protection against the representation of product differ ences which hardly exist, can best be effected by means of regulations and other initiatives concerned with the supply of information, such as labelling requirements.
